Terms & Conditions
1. Introduction
Thank you for choosing THAT Cake Lady. We are a UK-based Bakery & Cake Marker who take pride in creating cakes & Bakes that taste as good as they look! By placing an order, you agree to the following Terms & Conditions, which are designed to ensure a smooth and enjoyable experience for both of us. These Terms & Conditions also govern the sale of cakes and baked goods (“Products”) by THAT Cake Lady to customers ordering for postal delivery within the UK. By placing an order, you agree to these Terms.
2. Orders & Payments
- For our standard cakes and bakes including purchases from The Cully Cake Shed, full payment is required at the time of ordering or purchase. Orders are confirmed once full payment has been received.
- All Postal orders must be placed via website/email/phone/social media channels and paid in full at the time of ordering.
- We reserve the right to decline or cancel any order (with a full refund) if we cannot fulfil it.
- For Celebration / Event / Bespoke Cakes and Large Orders - A non-refundable deposit of £30 or 25% of the Order, whichever is greater is required to secure your booking.
- Orders are confirmed only once the deposit has been received.
- The remaining balance is due no later than 5 days before your collection or delivery date.
- For pre-booked Orders for our Celebration Cakes over £500.00, we do accept a payment plan which can be started twelve months prior to the Order Collection / Delivery date. This is at the discretion of the Manager and may be withdrawn at any time.
- Late or missed payments may result in cancellation of your order.
3. Cancellations & Refunds
- Deposits are non-refundable under any circumstances.
- Cancellations made more than 6 Weeks before the event may be eligible for a partial refund of any balance paid (excluding the deposit).
- Cancellations within 4 Weeks of the event are non-refundable.
- Standard/Non-Bespoke Web-Shop/Postal Orders may be cancelled within 24 hours of purchase for a full refund, unless already dispatched.
- In the rare event we must cancel, a full refund will be issued.
4. Products, Design & Alterations
- We will do our best to match your chosen design, but as all cakes are handmade, slight variations may occur.
- Any design changes must be requested at least 14 days before your event and may incur additional costs.
- We reserve the right to make minor changes to ensure the structural integrity and quality of your cake.
5. Allergies & Dietary Information
- Our cakes are made in a kitchen that handles allergens including gluten, dairy, eggs, nuts, and soy.
- Ingredients and allergen information are available on request and are listed in full on both our website and on the product packaging.
- While we can offer cakes free from certain ingredients, we cannot guarantee they are 100% allergen-free.
- It is your responsibility to inform us of any allergies or dietary requirements when placing your order.
6. Postal / Courier Delivery
- We dispatch via Royal Mail/DPD/Local Courier using tracked/next-day/express delivery methods.
- Delivery dates are estimates; we are not liable for delays caused by postal services.
- Risk passes to you upon delivery to the address provided.
- If our products arrive in a damaged condition, please ensure that you report this to us within 24 hours of delivery with clear photographic evidence.
- We cannot be held liable if you are not at the arranged address to take receipt of your delivery and it is returned to the Delivery Office.
7. Collection & Local Delivery
- Collection times must be agreed in advance. Please arrive promptly to ensure your cake is at its best.
- If you fail to collect your Order on the pre-arranged date and time, a late penalty payment maybe be charged.
- For deliveries, we will take every care to ensure your cake arrives in perfect condition. Once delivered and accepted, responsibility passes to you.
8. Storage & Care
- Cakes should be stored as advised at the time of collection or delivery. All cakes will come with written Cake Care Guidance.
- Please ensure that you have appropriate storage in a cool, dry place away from direct sunlight and heat sources prior to collecting your cake, especially in hot weather.
- Refrigeration is not recommended unless directly advised for specific cake types.
- Once collected or delivered, we cannot be held responsible for any damage caused by improper handling or storage. If there is accidental damage or deterioration to the cake after it has been collected or delivered, whilst we are not obliged to make alterations, we may do so at an additional cost if we have capacity to do so. This will be at the discretion of the Manager.
9. Photography & Promotion
- We may photograph your cake for our portfolio and for marketing purposes.
- If you would prefer that we do not use your cake for marketing or promotion purposes, please let us know at the point of ordering that you do not wish for your cake to be photographed by our Team.
10. Liability
- We are not liable for any indirect or consequential loss arising from the use of our products.
- Nothing in these Terms limits your statutory rights under UK consumer law.
11. Governing Law
- These Terms & Conditions are governed by the laws of England and Wales, and disputes will be subject to the exclusive jurisdiction of the English courts.
